Samsung is practically throwing a party even though it was found guilty of infringing upon three of Apple Inc. (NASDAQ:AAPL)’s patents in the latest case. John Quinn, an attorney for the Korean electronics giant, said in an interview with CNET that Apple won’t get anything from that judgment and will be soon giving it all up entirely because there’s just no point.
Apple giving up hope?
Quinn said Apple Inc. (NASDAQ:AAPL) is going to give up chasing Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) for patent infringement because it hasn’t been able to make a dent Android’s market share. He thinks that Apple thought it could “cripple Android somehow” by suing Samsung repeatedly. However, he believes the company has gotten the message now that it can’t win.
He said Apple Inc. (NASDAQ:AAPL) doesn’t have anything to show for the hundreds of millions of dollars it has spent on lawyers and lawsuits against Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930). He thinks the company is “looking for a graceful exit” and that the smartphone wars between Apple and Android will be ending soon.
Apple and Samsung both found guilty
Both Apple Inc. (NASDAQ:AAPL) and Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) were found guilty of patent infringement in the case that ended on Friday. The judge ruled that Samsung infringed on three of the five patents Apple claimed were being infringed upon. The judge also ruled that Apple infringed on one of the two patents Samsung claimed it had.
The judge ordered Apple to pay Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) $158,400, which is just a tiny fraction of the $6.2 million Samsung had been seeking in the case. The judge ruled that Samsung should pay $119.6 million to Apple, but Samsung expects that judgment to be thrown out. It’s been years since the two companies began suing each other repeatedly, and Quinn boasted that Samsung still hasn’t paid a dime to Apple in connection with any of the cases.
Apple claims victory too
After the judge handed down the ruling, Apple Inc. (NASDAQ:AAPL) released a statement saying that it “reinforces” what courts all around the globe found in the past: “that Samsung willfully stole our ideas and copied our products.”
Attorneys for Apple Inc. (NASDAQ:AAPL) argued in the case that Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) had purposely infringed on its iPhone and iPad patents because it didn’t have its own technology which would make it possible to compete. They also said that the reason Samsung has risen through the ranks in the smartphone industry was because it was simply copying the iPhone’s features.
Samsung accuses Apple of attacking Android
Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) argued in court that Apple Inc. (NASDAQ:AAPL) was trying to take a chunk out of the Android operating system and was suing Samsung just to do that. Apple, however, claimed that the lawsuits didn’t have anything to do with Android.
During the trial it was discovered that Google Inc (NASDAQ:GOOG) helped Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) defend itself on two of the patents. Those two patents were the two the judge ended up deciding that Apple did not infringe upon, out of the five that were being contested.
