Apple Devices Do Not Even Use The Patents In Question: Samsung

Apple Inc. (NASDAQ:AAPL)’s patent battle with Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) continues as the two leading smartphone makers accuse each other of various offenses. In Tuesday’s closing statements for the latest patent infringement case, lawyers for the Korean electronics giant claimed that Apple’s iPhone does not even include at least three of the patents Samsung has been accused of violating.

Samsung attorney Bill Price said in a statement, “You can’t copy if it’s not there.”

Samsung devices fully based on Android

In this particular patent case, Apple Inc. (NASDAQ:AAPL) accused the Korean firm of infringing on five of its patents and is asking for more than $2 billion in damages. According to the iPhone maker, many of Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930)’s phones and tablets use its patents. Price says that the damage amount is forcing Apple to accuse Samsung of copying and stealing, saying, “They have to get you a little angry to justify this number.”

Making it sound simple, Price argued that Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) followed what other smartphone makers did, which is using Google Inc (NASDAQ:GOOGL) (NASDAQ:GOOG)’s Android operating system to compete with the iPhone. Price says Android is the “world’s alternative” to Apple’s iOS.

Price claimed that each of the patents Apple Inc. (NASDAQ:AAPL) has accused Samsung of infringing on is part of the core Google Inc (NASDAQ:GOOGL) (NASDAQ:GOOG) experience. Apple has also questioned the authenticity of the Galaxy Nexus, which has been developed fully by Google.

John Quinn, another one of Samsung’s attorneys, noted that Apple Inc. (NASDAQ:AAPL)’s intention behind asking for $2 billion in damages is to artificially inflate the worth of the technology and confuse the jury.

“They’ll be dancing in the streets in Cupertino if you give them $100 million,” Quinn said.

Apple-Samsung patent battle

Apple Inc. (NASDAQ:AAPL) and Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) have been waging the patent battle around the world for three years. In a 2012 trial in San Jose, Calif., the jury ruled in favor of Apple, awarding the iPhone maker about $930 million in damages. However, U.S. District Judge Lucy Koh was not convinced to impose a permanent injunction on Samsung phones.

Presently, the case involves five of Apple Inc. (NASDAQ:AAPL)’s patents that were not covered in the 2012 trial. The patents in question relate to Apple’s slide to unlock and search technology. For infringing its patents, Apple is asking the jury to ban the sales of many Samsung devices, including the Galaxy S III, and award around $2 billion in damages.

Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) lawyers, after finishing with their defense, plans to accuse Apple Inc. (NASDAQ:AAPL) of breaching two of its patents. Apple will then have to defend itself against Samsung’s counterclaim.
