eBay Seller Sues Buyer For Bad Feedback

A seller registered with eBay Inc (NASDAQ:EBAY) has filed a suit against a buyer, for giving a negative feedback and also declining to withdraw the comment.

Amy Nicholas posted her negative feedback on the eBay Inc (NASDAQ:EBAY) seller site Med express because she had to pay $1.44 postage charge, which she didn’t expect, and according to her, was not informed by the seller beforehand.

Amy Nicholas bought a microscope part from the Med Express in February. She paid $12 as the transit price in addition to $175 purchasing price. Amy processed her transaction through PayPal, but when the device was delivered it was tagged with an extra $1.44 postage due.

Med Express, a registered seller with eBay has a positive feedback percentage of 99.3 percent and only 2 out of 298 ratings are negative.

Nicholas, who is operating under eBay Inc (NASDAQ:EBAY) moniker chimera_studios, posted “Order arrived with postage due with no communication from seller beforehand. It was logged as a negative feedback on eBay.”

Med Express quickly responded, saying “Sorry – no idea there was postage due. This has happened a lot (sp) from USPS lately.”

Med Express said that it tried to correct the problem as soon as it heard from the Amy Nicholas. The seller said to reimburse the postal charge, but Nicholas did not give any chance to Med Express, and on February 26, 2013, posted a negative feedback and comments for the eBay’s website. Nicholas also gave low ratings to Med expressing the Detailed Seller Ratings section of eBay’s Feedback Forum. According to Med Express this action created the negative image of the seller, and it lost customers as well as income as the result of the feedback.

 Now the seller at eBay Inc (NASDAQ:EBAY) wants ruling in their favor to remove the negative feedback and also compensate for damages both punitive and reparative.

Paul Levy of the Public Citizen Litigation Group (on behalf of Nicholas) told that the feedback was true. He said that Med Express offered to reimburse for the extra cost, which Nicholas paid, but she wanted to point out the confusion and hassle that she faced in this whole transaction and not the money.

He also said in a letter to Med Express that the opinion of Nicholas might be either right or wrong, but that does not prevent her from echoing her opinion. It cannot be made as a reason to ask for compensations, attorney fees, and an injunction.

He went on to say that customers should keep this incident in consideration when they do any future transaction with eBay Inc (NASDAQ:EBAY)’s Med Express and this action of Med Express will harm the image of the company as it will imply that Med Express was deliberately using the shipper for this long, who it knew can let the consumer pay the postal charges.
