The Apple Inc. (NASDAQ:AAPL) vs. Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) patent trial saga will continue later on this year. The new trial is set to begin November 12th.

Last August, Judge Lucy Koh ruled in Apple’s favor but since then has given a management order for a new trial to recalculate the initial $450.5 million that was awarded to Apple. This new trial will assess whether the jury’s decision was incorrect. Koh claimed that the jury’s initial calculations were wrong and this new trial will decide the final amount Apple will receive from Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930).

The new amount could be more than or less than $450.5 million. That number was already reduced from $1.05 billion. Koh thinks the jury made a decision on a lack of understanding of patents and legal issues.

The new court order won’t allow Apple Inc. (NASDAQ:AAPL) or Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) to expand the trial to include additional products, sales data, or theories. Apple wanted to increase the award but Koh ignored their request. Instead, she opted for a new trial that was based exclusively on 14 devices and that included the Samsung Galaxy S III. This particular trial was designed to reinstate the cut damages from the initial award.

The court added that the order was reinstated specifically for Galaxy S II for AT&T Inc. (NYSE:T). But the device won’t be included in the upcoming court battle. The damage award for the particular device was initially scrutinized over the incorrect time frames. Apple Inc. (NASDAQ:AAPL) is entitled to damages accrued during the sales period after which the company issued the notice.

When Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) asked for a trial delay because of their supposed concern whether Apple’s patent claims were valid, Apple Inc. (NASDAQ:AAPL) accused Samsung of taking their time.

It would be simpler if Samsung Electronics Co., Ltd. (LON:BC94) (KRX:005930) was willing to work with Apple Inc. (NASDAQ:AAPL) and come to an agreement but it doesn’t look like that will happen. In the meantime, we will have to wait until the end of the year to see what happens next.
