Apple Inc. (NASDAQ:AAPL) is targeting the Samsung Galaxy S3 and Galaxy Note in its amended patent complaint against Samsung Electronics Co., Ltd. (LON:BC94), which was filed with the U.S. District Court of Northern California on Friday.
In its amended patent complaint, Apple Inc. (NASDAQ:AAPL) requested a new jury trial and targeted 21 more Samsung products, including Galaxy S3, Galaxy S3-Verizon, Galaxy SII Skyrocket, Galaxy SII Epic 4G Touch, Galaxy SII-T-Mobile, Galaxy SII-AT&T, Galaxy Nexus, Illusion, Captive Glide, Exhibit II 4G, Stratosphere, Transform Ultra, Admire, Conquer 4G, and Dart smartphones. The Cupertino-based company aimed at Galaxy Player 4.0 and 5.0 media players; Galaxy Tab 7.o Plus, Galaxy Tab 8.9, and Galaxy Note 10.1 tablets.
Apple claimed the 21 additional Samsung products infringed eight patents such as:
- ‘172- methrod, system and graphical user interface for providing word recommendations
- ‘414- asynchronous data synchronization among devices
- ‘502- graphical user interface using historical lists with field classes
- ‘604 – universal interface for retrieval of information in a computer system
- ‘647- system and method for performing an action on a structure in computer generated data
- ‘721- unlocking a device by performing gestures on an unlock image
- ‘760- missed telephone call management for a portable malfunction device
- ‘959- universal interface for retrieval of information in a computer system
The Cupertino-based iPhone and iPad maker reiterated in its filing that the South Korean electronics manufacturer lavishly and systematically copied its product’s technology, features, and designs. According to the company, the amended filing aims to “put an end to Samsung’s continued infringement.”
There is no doubt Apple Inc. (NASDAQ:AAPL) wants to cripple the increasing popularity of Samsung’s flagship products, particularly the Samsung S3 smartphone and Galaxy Note 10.1, which were launched in June and August this year. Many technology reviewers believe both products are cool and highly competitive.
The Samsung S3 was received an excellent rating while the Galaxy Note 10.1 received a very good rating from CNET editors, while a majority of average users gave five star ratings for both products.
Apple emerged victorious in the patent battle against Samsung on August 24 and was awarded $1.05 billion in damages. The company is seeking a court injunction against eight Samsung products in the United States. A court hearing on the issue was set for September 20.
According to Apple, its victory in the case is not just about patents or money, but also values—“stealing isn’t right.” On the other hand, Samsung vowed to continue to fight against its rival, and pointed out the jury’s verdict is unfair to consumers.
Most recently, the District Court in Tokyo ruled in favor of Samsung on a similar patent case against Apple Inc. (NASDAQ:AAPL). Presiding Justice Tamotsu Shoji said, “It’s hard to believe the products belong to the range of technologies of the claimant.”
According to IDC, Samsung dominates the worldwide market share for smartphones, with a 32.6 % share during the second quarter of 2012. The company shipped 50.2 million units. Apple ranks second with a 16.9% market share and shipped 26 million units.
On the other hand, data from research firm, iSuppli, revealed that Apple led the worldwide market share for tablets with a 69.6 % share, while Samsung was far behind, with only a 9.2 percent share during the second quarter this year.
