Apple Sued By Man Because Of Siri Software's Alleged False Advertising

Apple’s (NASDAQ: AAPL) iPhone 4S contained the brand new product known as Siri. This intelligent personal assistant and knowledge navigator helps you find everything you need/want to do. The software is also supposed to assist you in finding places, making appointments, making calls, taking notes, etc.

Siri, became very popular and was the love interest of Raj in the “The Big Bang Theory”. Siri was featured in one episode on Season 5 of the Emmy award winner, TV Series.

But it seems that ads and the TV show are far from reality. Frank M. Fazio got a 32GB iPhone 4S, because he was impressed with what Siri was supposed to do. But when he actually used it he found out that it didn’t work as expected the story took a turn for the worse. Fazio says that the software didn’t understand him and even after waiting for a long time he would get a wrong answer.

Fazio decided to sue Apple for false advertising. Fazio claims that the device does not work in reality like Apple claims on its TV commercials. He was sure to put that specific statement on the complaint he filed with the U.S. District Court in San Jose.

The law firm Robbins Geller Rudman & Dowd is representing Frank M. Fazio; They have stated that the advertising is “fundamentally and designedly false and misleading” because Siri “does not perform as advertised.” Furthermore  Fazio claims that the iPhone 4S is just a more expensive version of iPhone 4 minus Siri.

The lawsuit is not only on behalf of Faizio. He has filed is a class action, which allows others to sue Apple because of Siri’s supposed false advertising. Apple has not responded to the complaint.

A few days ago during Apple’s presentation of the new iPad we were able to hear Siri speaking in different languages and accents.

This is the first legal complaint about the software; it is interesting that no one else had sued Apple over Siri.

Do you happen to have an iPhone 4S? What do you think about Siri’s performance?  Do you agree with Frank M. Fazio?
