Samsung has announced plans to drop patent injunction applications against Apple Inc. (NASDAQ:AAPL) in five different countries, reports WSJ. Unfortunately they still have many patent lawsuits against the Cupertino, CA-based company.
It’s reported that the injunction applications in the five countries (consisting of the United Kingdom, France, Germany, Italy, and Netherlands) will be removed.
Samsung Electronics Co., Ltd. (ADR) (LON:BC94) released the following statement; “Samsung remains committed to licensing our technologies on fair, reasonable and nondiscriminatory terms, and we strongly believe it is better when companies compete fairly in the marketplace, rather than in court. In this spirit, Samsung has decided to withdraw our injunction requests against Apple Inc. (NASDAQ:AAPL) on the basis of our standard-essential patents pending in European courts, in the interest of protecting consumer choice.”
The battle between Samsung and Apple Inc. (NASDAQ:AAPL) only seems to be getting more heated as time progresses. Apple Inc’s (NASDAQ:AAPL) recently requested for permanent injunctions against Samsung Electronics Co., Ltd. (ADR) (LON:BC94) in the United States. Judge Lucy Koh wrote the following statement, “Apple’s evidence does not establish that any of Apple Inc. (NASDAQ:AAPL)’s three design patents covers a particular feature that actually drives consumer demand. The Court further found that though there was some evidence of loss of market share, Apple Inc. (NASDAQ:AAPL) had not established that Samsung’s infringement of Apple Inc. (NASDAQ:AAPL)’s design patents caused that loss.”
Koh also denied Samsung request for a retrial because of apparent jury misconduct.
If there is anything that can be learned from this courtroom battle, it is that Apple Inc. (NASDAQ:AAPL) is clearly doing something right. They are the only company that has been successful enough to win many of the patent lawsuits that have been filed over the years. Last summer they won a $1.05 billion lawsuit in a California court.
Although it doesn’t look like the Samsung-Apple lawsuits will end anytime in the near future, it’s possible that Samsung Electronics Co. Ltd. (ADR) (LON:BC94) may be backing down a bit on their end. Perhaps they know that they cannot win the majority of these lawsuits, which is why they are backing out of certain cases while they are still able to.
